The definition of owner under the London Building Act 1930 was held by the Court of Appeal not to include a receiver who had been appointed by the building society under the mortgage and collected the rents as agent for the mortgagor. The wording of the Act did not include an agent. It seems that this would also apply to the Party Wall etc. Act 1996.
