Summary

The first defendant was an engineer who had invited the claimant contractor to supply a quotation for repair works at a property owned by the second defendant. The engineer subsequently accepted the quotation, but neglected to inform the contractor that he was acting as an agent of the second defendant.

The court held that the engineer had contracted personally with the contractor and was responsible for payment.
