Summary

The plaintiff owned a property with a right to light over property owned by Mr Henson. Mr Henson constructed new buildings on his land (in place of the original shed) which completely obstructed one of the plaintiff's windows. Mr Henson then leased the new buildings to the defendant. The plaintiff brought an action against the defendant in respect of the obstruction. The Chief Justice decided that a plaintiff could not claim against a tenant who had no power to remove the obstruction. If the plaintiff in this action had any remedy for the obstruction, he should have claimed it against the freeholder, Mr Henson.
