Summary

Summarising the law, Fry LJ said:

'As the same vendor is selling to two persons at the same time, each purchaser is entitled, in favour of the house he buys, to the benefit of the maxim that no man shall derogate from his own grant but, at the same time, he has the burden of the same maxim in favour of his neighbour's house; and the result is, that all the quasi easements which existed between the two lots in the hands of the one owner, the vendor, are perpetuated by way of implied grant, in the hands of the respective purchasers.'
