In this case the contractor resurfaced a car park, but not in accordance with the specification/contract, although the car park constructed was usable for the intended purpose.

The Court of Appeal used an appropriate objective test to calculate damages. Instead of damages being based on the cost to put the car park right, the damage was the difference in value if it had been constructed to the right specification.
