Summary

The building owner submitted an account which set out the details of the actual costs rather than the costs to which he was entitled under the relevant Act. The judge decided that this was sufficient compliance with the Act and that the building owner was entitled to the amount properly calculated in accordance with the Act.

Section 14(2) of the 1996 Act provides that, until the adjoining owner pays for works in accordance with the account served under section 13, the property in such works remains in the building owner. It is not clear how this provision would be enforced against a subsequent purchaser of the adjoining owner's property.
