Summary

A subcontractor had inadequately propped a roof during the course of some works with the result that the roof collapsed. The inadequate propping was done to the order of the ultimate employer's engineer.

The fact that the separate consulting structural engineers and the subcontractor's site agent both considered the propping to be inadequate (and said so at the time) did not negative the implied duty that existed for the subcontractor to warn of the danger which it perceived existed. Whether such an implied duty existed depended on the facts of each case.
