Summary

The claimant had contracted with the defendant to carry out certain building works. By the contract, an official of the defendant called the Director of Works was held by the Court to be appointed as a certifier under the contract. Disputes arose between the parties in relation to the claimant's applications for extensions of time. It was held that there was an implied term in the contract that the defendant would not interfere with the Director of Works' duties as certifier.
