In order to make the procedure workable in an arbitration, contractors should endeavour properly to represent the sub-contractor's case jointly with their own, with any arbitration taking place by way of concurrent hearings. In this case, the Court of Appeal held that a sub-contractor to a building contract between 2 other parties did not have to take part in tripartite arbitration.
