Summary

Lord Atkinson in the House of Lords stated that, in determining whether or not the quantity of light which the dominant owner would continue to enjoy would be sufficient, regard could only be had to the light that owner is by grant or prescription legally entitled to enjoy. Light which could with impunity be obstructed and windows that could at any time be almost entirely blocked up or altogether darkened, must be excluded from consideration.
