Summary

In a landlord and tenant dispute, the court granted permission for the parties to instruct 1 expert witness each on restaurant valuation. The landlords sought to rely on the evidence of a second expert witness. Following Beck v Ministry of Defence, the judge held that the landlords required permission to appoint a second expert but that the court would grant it provided the first expert's report was disclosed to the tenant. But the Court of Appeal upheld the landlords' appeal.

Whereas in Beck the order had identified the 2 experts, so that their reports should be disclosed even if they were not relied on, here the order deliberately only identified the area of expertise. The landlords could therefore rely on another expert from that area if they chose.
