Summary

The defendants were appointed as architects in respect of the construction of an office block. Specialist subcontractors (Alpine) negligently designed the curtain walling, and admitted liability to the claimant developer, before going into liquidation.

The court held that in failing to make proper enquiries about Alpine or asking specialist curtain wall consultants to so do, the defendant was negligent in selecting Alpine to carry out design works. Further, the defendant failed to properly involve the curtain wall consultants when revised designs were received from Alpine prior to their acceptance by the claimant.
