A provision of the London Building Act 1894 required warehouses, above a certain size, to be divided by party walls. Parts of the building were to be 5 storeys high, while others were to be only 1 storey in height. It was held that a wall that was a party wall because it divided adjoining buildings or, as here, divided portions of a warehouse, was not a party wall at a height above which it stopped fulfilling that function.
