Summary

The defendant had served notice under the relevant Act and built a wall in accordance with the award of the 3 surveyors. The plaintiff started proceedings for an injunction, claiming that the wall interfered with his rights of light. The plaintiff's claim succeeded. The court rejected the argument that the dispute as to the right of light should be determined by the surveyors. The court considered that as the building owner had no right to raise a party wall so as to interfere with the right to light, there was nothing under the Act in relation to which the surveyors could make an award.
