Summary

In this case, the House of Lords held that the withdrawal of a nominated subcontractor was not the 'fault' of the employer and, in the absence of a contractual provision entitling the contractor to an extension of time therefore, the contractor was not permitted to claim an extension to the completion date. This case is often cited as authority for the proposition that if a contract contains no express power to extend time for a delay which is not the fault of the employer, the contractor assumes risk for that delay.
