Summary

ABB sought a declaration that installation of pipework was not a construction operation. HH Judge Humphrey Lloyd QC. held that one had to look at the nature of the project, rather than the individual works. In this case, it was held that the aim of those implementing the project was the assembly and installation of plant - which was one of the exclusions noted in section 105(2) of the HGCRA 1996 and accordingly the Act did not apply.
