Summary

The landlord needed the demised premises for its own business but was not able to oppose on ground (g) (own occupation) because it had acquired the reversion less than 5 years prior to the termination of the original lease under section 30(2). The tenant wanted a long term of 12 years and the evidence was that a shorter term would cause it hardship since it had fitted out the premises and would have to pay more for other premises. The Court of Appeal held that the first instance judge had been right to have regard to the 5-year period in section 30(2) in granting a 3-year extended lease only.
