Summary

In this case, there was a provision in the lease requiring the tenant to pay to the landlord all costs, charges and expenses including legal and surveyor's costs of, and incidental to, the preparation and service of any notice by either party on the other under the 1954 Act and all negotiations subsequent thereto and of all proceedings thereunder and to keep the landlord indemnified against all costs in respect of such notices, negotiations and proceedings. The provision was held to be void since it was the imposition of a penalty on the tenant.
