Commercial property - landlord and tenant – service charge - management fees – lease providing for service charge to include cost of employing managing agent – whether management fees paid to a company formed by the landlord to manage the properties was recoverable under the service charge
Summary

It was held that management fees paid to a company formed by the landlord to manage the block and other properties were recoverable. The leases provided for the service charge to include the cost of employing a managing agent and the court found there was no reason why a landlord should not employ a company and recover the fees paid, even if he or she owned that company, provided that it was not a complete sham.
