Summary

The County Court held that there was no business tenancy where the tenant was a self-employed decorator who had notepaper printed with his home address and telephone number, on which it was stated that he was a decorator. His wife typed his estimates and bills at home and kept the books, but he kept his decorating equipment elsewhere. In his business accounts, he claimed a proportion of the rent and telephone bill against tax.
