In the case of a lease entered into before 1 January 1996, where a tenant has assigned its interest, it usually has either an express or implied indemnity from the assignee that the assignee will pay the rent under the lease and otherwise comply with its obligations. If the lease is further assigned, the first assignee will have a similar indemnity from the further assignee. However, the tenant cannot require the first assignee to enforce the indemnity of which it has the benefit against the further assignee.
