Summary

During the term of his previous lease, the tenant had made voluntary improvements to the premises. The rent review clause of his new lease provided for the disregard of 'any effect on rent of any improvement carried out by the Lessees ...'. This was not expressly limited to improvements made during the term of the new lease, but neither was there any reference to the preceding lease. The landlord successfully argued that the new lease demised the premises as they existed at the date of the new lease, so that the works previously carried out by the tenant were no longer considered to be improvements.
