Summary

It was held that where premises are ripe for development and the landlord genuinely intends to develop in the near future, any new tenancy should necessarily be of short duration. Therefore, in such a case, the Court of Appeal held that the judge had erred in granting a fixed term of 9 years and reduced the term to 12 months. The length of the original lease and the length of time that the premises had been occupied by the tenant since the expiry of the term were also relevant considerations to take into account.
