Summary

The landlord was willing to consent to a deletion in the current service charge provisions so as to exclude any contribution from the tenant for maintenance, repair and redecoration of the building and for long-term repairs of the lifts and boiler installations. The tenant contended that no service charge should be payable at all. The court held that, whatever the length of the tenancy, there was no prospect that the court would consider that it was reasonable to remove the tenant's liability to pay the service charge completely.
