Generally, the time at which the landlord will have to prove the ground(s) on which it relies will be the date of the hearing of the application for permission.

Careful consideration must be given to each of the grounds. Only one needs to be satisfied for the court to be able to exercise its discretion to give permission to proceed. If the 1938 Act applies and permission is to be sought, the proceedings seeking permission will have to be accompanied by appropriate evidence supporting the ground to be relied on.
