Summary

The first instance judge was satisfied that there was a possibility of a bona fide decision to operate a break clause in future but did not insert a break clause into tenancies of 10 and 12 years' duration. The Court of Appeal indicated that if the landlords might wish to develop they should not be saddled with a lease which prevented such development and it was wrong in such cases to grant tenancies for substantial terms with no redevelopment break clauses. In that case, redevelopment break clauses exercisable at the fifth year of the term were inserted.
