Summary

Acquiescence by the landlord in the tenant's persistent failure to pay rent on time estopped both the landlord and his successor in title from relying on ground (b) unless reasonable notice was given to the tenant to revert to strict compliance with the terms of the lease. On the facts, there had been repeated minor breaches in the tenant's obligation under the lease to pay rent. A Schedule of Arrears prepared for March 1997 to December 2000 showed that rent was between 1 and 21 days in arrears for each quarter. Rent was paid by cheque and a period had been allowed for the rent to clear.
