The landlord had granted licences for alterations which imposed an obligation on the tenant to carry out the alterations. The landlord contended that the works were therefore obligatory and that they fell outside the direction in the rent review clause to disregard the effect of voluntary improvements, but the tenant successfully argued that the works were to be treated as voluntary improvements for the purpose of the rent review clause.
