Summary

In considering whether VAT should be a recoverable head of damages, the court allowed this element of the claim even though there was a possibility that landlord might not carry out the works and incur the VAT ‘loss’.

The landlord claimed, as one of its heads of claim, the loss of rent suffered by virtue of not being able to let the property during the period required to carry out the work of repair necessitated by the tenant's breach of covenant. It is often a significant item.
