In a case concerning enfranchisement issues and whether the landlord should receive compensation in the price to be paid to it for the loss of the ability to develop the roof of the property, the Lands Tribunal concluded that it should not because the landlord would not be able to give effect to any plans it might have had to do such work as to do so would break its covenant to repair the roof.
