Summary

In a case of the renewal of a business tenancy under the Landlord and Tenant Act 1954 in which the question as to whether or not the landlord was under a repairing obligation was relevant, the Court of Appeal said:

'Moreover, it is a phenomenon, certainly known at common law, that there may be situations in which there is no repairing obligation imposed either expressly or impliedly on anyone in relation to a lease.'
