Summary

The current tenancy restricted use to the tenant's business as a cutler. The landlord wanted to include a proviso that the landlord's consent to a change of use was not to be unreasonably withheld in order to increase the rent payable. The court refused to include the proviso so as to relax the user covenant against the tenant's wishes. It was not reasonable to increase the rent by widening the user clause beyond that which the tenant required in order to carry out its business, even though its inclusion would have increased the assignability of the tenancy.
