Summary

The qualifying work would have prevented trading for 12 weeks - it would be impossible for the tenant to run his cafe business and for that period the landlord would be required to use the whole of the cafe premises, although cafe equipment could be shifted from one room to another without removing it from the premises.

The Court of Appeal (overruling the decision of the first instance judge) held that the nature of the interference for a period of 12 weeks was interference, to a substantial extent and for a substantial time, with the use of the cafe for the purpose of the business carried on by the tenant.
