Summary

In response to a landlord's trigger notice proposing a new rent, the tenant replied by letter acknowledging the notice proposing the rent 'which I consider to be excessive'. That was a valid counternotice, since the review clause simply required the service of a counternotice which stated that the lessee did not agree with the rent stated in the lessor's notice. The rent review clause did not require the counternotice to state that the lessee wished the matter to be referred to independent determination.
