Summary

The tenant covenanted to offer to surrender his tenancy before assigning it. Since the effect of the agreement to surrender in this case would have been to preclude the tenant from applying for a new tenancy under the 1954 Act, the agreement was void and unenforceable. Joseph v Joseph [1966] was followed.
