Summary

The trustees of a members' lawn tennis club registered under the Industrial and Provident Societies Act 1893 entered into an agreement with the owners of tennis courts and a clubhouse to use and enjoy the premises for 2 years in consideration of monthly payments of 'court fees'. It was held that the agreement created a tenancy and that the premises were occupied for the purposes of a 'business' as defined by section 23(2) of the 1954 Act, as the 'activity' of a lawn tennis club was carried on.

A document will be a lease not a licence, whatever it is called, if in essence it is a lease.
