Summary

The plaintiff had originally had a right of way through a back door, which he then closed off for 30 years. He then re-opened it, and had used it for 4 years before the defendant obstructed it. The Court held that there had been no abandonment, but noted that if the defendant had commenced building before the back door had been re-opened, the plaintiff would have been estopped from denying abandonment.
