Summary

The servient owner granted a right to use 'the path or roadway' lying between two properties. At the date of the grant two-thirds of the 'path' had been a flower bed. The Court of Appeal held that the dominant owner was entitled to access over the whole of the 'path', the flower bed being sufficiently transient, insubstantial an obstacle that its existence could not be said to have limited the grant.
