Summary

The plaintiff and the defendant owned semi-detached houses. The defendant allowed her house to become neglected and the local authority eventually demolished it. The plaintiff's property, as a result, suffered from loss of support, exposure to dry rot and the weather. The court decided that, as there was an easement of support and this was a party wall, the plaintiff was entitled to have his house weatherproofed.
