Summary

A party enjoyed a right to a supply of water from a tank. He then entered into a licence entitling him to construct a new tank in a different location and take his supply from that. The licence was subsequently determined. The Court of Appeal held that the previous right was impliedly abandoned when the licence was accepted, the new tank installed, and the previous one demolished.
