Summary

In a lease with a provision apparently intended to reach the same result, the court said that, had it been required to make a decision on the issue (which it was not), it would have concluded that there was a condition precedent which would have meant that the Yorkbrook decision would have been overruled. Since the court did not have to actually decide the point, Yorkbrook remains current (but doubted) case law.
