Summary

The defendant valuers were instructed by a firm of mortgage brokers to value a particular property. The valuers were aware that a decision on lending would be based on their valuation but had no knowledge of who the ultimate lender might be. It was held that the valuers would owe a duty of care to any lender to whom the brokers passed on their valuation report and who duly relied on it.
