The owner of an alleyway installed gates at both ends to prevent vandalism and to prevent members of the public using it as a right of way to access nearby properties. The court held that locking the gates over a period at Christmas was not enough to rebut the presumption of dedication. The landowner had failed to make clear his intention not to dedicate a public right of way.
