Summary
The lease is arguably the most important of commercial property documents. This section covers the leasing process, the documents involved and what a lease contains. Key topics include preliminary issues such as instruction, types of lease, ancillary documents, parties and liabilities, extent of demise, lease or licence, agreements, covenants, rent review, length of terms, conditions of a lease, land registration and stamp duty.
Note that, although commercial leasing practice in Scotland and Northern Ireland is similar, the legal systems are different from those in England and Wales.
