Health and safety responsibilities

Legal responsibilities for health and safety may arise for a surveyor who is providing health and safety advice and/or who is considered to be in control of a building or workplace.

Advice may be provided to the occupier or tenant or to the landlord. For the occupier it will cover the Health and Safety at Work etc. Act 1974, asbestos and fire risks, Occupiers' Liability Acts and penalties for non-compliance.

The nature of advice a surveyor may provide to a landlord is likely to reflect such things as the type, condition and age of the building and the purpose for which the building is to be put.
