Summary

The applicant occupied farms in excess of 2,000 acres. The holding consisted of a number of disparate pieces of land, some of them separated from each other by several miles. The local planning authority took enforcement action in respect of the storage of grain for commercial purposes on certain of the farms. In coming to his decision as to whether there was a material change of use, the Secretary of State did not regard the entire holding as one planning unit. The Court of Appeal upheld this decision. The identification of the planning unit is a question of fact and degree, first for the local planning authority and then for the Secretary of State to decide.
