Summary

In a commercial rent review dispute heard in arbitration, both sides gave evidence about alleged valuation comparables based on hearsay evidence as to facts. It was later argued that this was not admissible. The judge noted that the objections to hearsay had not been made until after the award in an attempt to re-open the case. It was held that hearsay should be objected to at the time it was presented, otherwise such evidence became admissible by agreement and a tribunal would then need to assess the weight that should be given to it.
