The judge made a number of findings on procedural fairness in this case, an application to the High Court under the Town and Country Planning Act 1971 by a developer after planning permission was refused. The case editor for the Journal of planning and environment law, Professor Michael Purdue, noted that the judge:
'placed less weight on the planning officer's evidence because he had combined the role of witness with that of advocate at the inquiry'.
This refers to a local planning inquiry where a planner or, for example, a chartered surveyor, might be allowed to combine the roles.
