In this case an arbitrator found that there had been a delay in completion but declined to award liquidated damages on the grounds that the employer had suffered no resulting loss. His Honour Judge John Davies QC heard the appeal held that even if the employer has not suffered a loss as a result of the delay of the contractor, as long as the liquidated damages reflect a genuine pre-estimate, they were still payable.
